Scope and Content:
New Hampshire Supreme Court case file #4310 Herbert E. Butler v. Roscoe B. King and Arthur L. Blanchette d/b/a Roscoe B. King Company, 1954. The documents in this file include the defendant's brief by Devine and Millimet and the plaintiff's brief by Donald R. Bryant of Burns, Calderwood, and Bryant. Both of these documents include notes, particularly on the cover, presumably by Frank R. Kenison, and state the case is an action of negligence against the defendant for an accident resulting in injuries to the plaintiff, a painting contractor, on a construction site at the Tides Hotel in Hampton, NH. Also included is a letter from Kenison in Concord, NH, to Professor Fleming James Jr. at Yale University in New Haven, CT, dated July 2, 1954 requesting an opinion on a rehearing; a reply from Fleming to Kenison stating he is in agreement with the result of the case; and two memos, one from Amos Noyes Blandin Jr. and one dated June 24, 1954 from Laurence Ilsley Duncan, providing their opinions on the case. The final document in this file, the New Hampshire Superior Court case of Butler v. King dated 1953, has been cataloged separately at the item level due to its size. See: 1981.112.4310.001
