Scope and Content:
New Hampshire Supreme Court case file #3803 Ellen J. Holmes v. Clear Weave Hosiery Stores, Inc., May and June session 1949. The documents in this file include a summary of the defendant's oral argument by George P. Cofran that the failure of the trial court to give the defendant's requests was a reversible error, a vote from Justice Amos Noyes Blandin Jr. against a motion for a rehearing of the case, the defendant's motion for a re-hearing by Cofran, and a memo providing Justice Laurence I. Duncan's opinion on the case's motion for a rehearing. The argument for a rehearing states the jury was not appropriately instructed as to the defendant's request on the day of the accident, in which the plaintiff fell down a set of stairs in the backroom of the Clear Weave Hosiery store, and that the evidence regarding how well-lit the room, as opposed to the claim it was poorly-lit, was ignored as the court devoted its attention to the issue of contributory negligence.
